Penerapan Sanksi Pidana Terhadap Anak Sebagai Pelaku Pada Tindak Pidana Kekerasan Seksual

Kemajuan teknologi telah membawa perubahan besar dalam kehidupan manusia, namun juga meningkatkan insiden kekerasan seksual yang melibatkan anak-anak sebagai korban dan pelaku. Di Indonesia, kasus pelecehan seksual terus meningkat setiap tahun. Berdasarkan data dari Kementerian Pemberdayaan Perempuan dan Perlindungan Anak (PPPA), terdapat 15.120 kasus kekerasan terhadap anak di Indonesia pada tahun 2023. Dari data tersebut, bentuk kekerasan yang paling dominan adalah kekerasan seksual sebanyak 2.363 kasus atau setara dengan 34,8 persen, diikuti oleh kekerasan psikologis, fisik, dan ekonomi. Tujuan penelitian ini adalah untuk mengetahui apakah penerapan sanksi pidana terhadap anak-anak sebagai pelaku kejahatan kekerasan seksual telah efektif dalam kehidupan sosial di Indonesia. Penelitian ini menggunakan jenis penelitian normatif, dengan pendekatan undang-undang dan pendekatan kasus. Berdasarkan hasil penelitian, diketahui bahwa Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak belum cukup mengatur secara spesifik bagaimana pelaku anak mendapatkan sanksi atau efek jera dalam melakukan Tindak Pidana Kekerasan Seksual. Hal ini disebabkan sistem hukum di Indonesia masih belum kuat yang tidak secara eksplisit mengatur berbagai sanksi.
